These Terms & Conditions (“Terms”) govern your use of the website, forms, surveys, communications, and services provided by XLab Marketing (“XLab,” “we,” “us,” or “our”).

Services
XLab Marketing provides marketing, advertising, lead generation, customer communication, and automation services for mobile detailing businesses. Services may include advertising strategy, Meta/Facebook and Instagram campaign support, lead forms, qualification surveys, CRM workflows, text messaging automations, onboarding support, and related business services.

Website and Survey Use
When you submit information through our website, advertisements, forms, or surveys, you agree that the information you provide is accurate and submitted by you or with proper authorization.
Submitting a form or survey does not guarantee acceptance as a client, specific business results, advertising performance, lead volume, or revenue.

SMS/Text Messaging Terms
Program Name: XLab Marketing Customer Care and Appointment Messaging
XLab Marketing provides customer care, booking, appointment coordination, and support messaging on behalf of participating mobile detailing businesses. When you opt in, you may receive text messages related to your car detailing inquiry, quote request, appointment scheduling, appointment confirmations, appointment reminders, rescheduling support, technician updates, customer service replies, and related account or service communications.
You can cancel the SMS service at any time. Just text “STOP” to the phone number that sent you the message. After you send “STOP,” we will send you a text message confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from this messaging program unless you opt in again. If you want to join again, you can sign up as you did the first time, and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your inquiry, appointment status, and customer service needs. If you have questions about your text plan or data plan, contact your wireless provider.

Client Messaging
If XLab Marketing provides messaging tools, automations, or communication services for a client, the client is responsible for ensuring that its contacts have provided proper consent to receive messages and that the client’s message content, business practices, and contact lists comply with applicable laws, carrier requirements, and messaging platform rules.

No Guarantee of Results
Marketing and advertising results vary based on market conditions, offer quality, budget, sales process, service area, competition, and other factors. We do not guarantee specific leads, sales, appointments, revenue, return on ad spend, or business outcomes unless stated in a separate signed agreement.

Acceptable Use
You agree not to use our services or communication systems to send unlawful, deceptive, harassing, abusive, spam, or prohibited content. We may suspend or terminate access to services if we believe your use violates laws, carrier rules, messaging policies, platform policies, or these Terms.

Payments and Agreements
Specific pricing, payment terms, cancellation terms, deliverables, and service commitments may be provided in a separate invoice, checkout page, written agreement, or service order. If there is a conflict between these Terms and a signed agreement, the signed agreement controls for that specific service.

Intellectual Property
All website content, branding, systems, workflows, copy, strategies, and materials created by XLab are owned by XLab or its licensors unless otherwise agreed in writing.

Privacy
Your use of our website and services is also governed by our Privacy Policy, available at xlabmarketing.com/privacy-policy.

Limitation of Liability
To the maximum extent permitted by law, XLab Marketing will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities.
